Not a "rattle snake" ID?

So my nice found this "rattle snake" in the gutter after a pretty good rainstorm.




Obviously not really a rattle snake, but what is he. He looks really familiar, I just can't come up with the name.

sorry the pictures are bad- I had to take them quickly before the hoard of children behind me trampled the poor thing.
