It's his own fault. "caveat emptor" (Buyer Beware)! He should have made you fill it up to prove that it is leak-proof. When you buy something from a flea-market, thrift store, garage sale or any other used/second-hand clothing, appliance, thing stores, you buy it "as is". You can't return it. He got a 100 gallon tank with no cracks or holes for $100. Why doesn't he just re-sell it for a higher price?
