Should I save this snake?

Hello all! I live in Michigan and the snow still comes and goes. It is in a condo community and there is a snake burrowed in the crack of the sidewalk. I'd figure I'd let it warm up and find a new home but spring is taking forever. We went on a walk with a neighbor with our dogs and she kept poking at it. I'm afraid someone else will come along and purposefully step on/kill it. I want it to live, I think its just a common garder snake. Im thinking of digging a new burrow off to the side and moving it gently. Temps around here are still 30-40. Here is a pic
