Unhappy gonna lose $1000.... Help! (non reptile related)

OK i signed up at a fitness club and i pay for my member ship and all. They asked me if i wanted to have a personal trainer, so i said naw i dont need it. So then the fitness said, OK if u sign up with us u can get a session free So i said why not. put down a 80$ deposite and i knew i was gonna get it back cuz i wanted to cancel after the session, this was a 70$ per session thing (16 sessions($1000). Couple days later i booked a session and then got called into work, so i called in and said to cancel my session ,48 hours early.

Couple weeks later i got a call from the fitness club saying when do u want your next session, i was like oh yea my personal trainer. Well i said i didnt want it anymore and i wanted my deposite back, they said You cannot get your money back and you WILL HAVE TO PAY FOR THE SESSIONS. I said i dont have that kind of money! and they said you could have canceled it in 5 days (NO BODY TOLD ME THAT!) What an outrage!! Well they needed my Void Check cuz i didn't give it to them yet, all i gave'em was my deposite. Do u think i should just let it go and not give them my check so they dont take out my money from my bank account!!!???

ooh what did i get myself into, they never mentioned that 5 day cancelation thing. I think i've been scammed...

Personally I wouldnt give them your cheque... As for getting back the deposit, I dont think it would be easy... Just go in and tell them what happened, they will probably keep the deposit but there is no way you should have to pay the full ammount.

i'm just so mad they didn't inform me that i could cancel it in 5 days! oh man... i dont know what im gonna do. College and a car is hard enough

Did they give you a receipt? No receipt=no payment. I am not a lawyer but was there a signed contract? Do you have a copy? Read it carefully! If I remember correctly if the blank check is not issued. Then there is no monthly withdrawls arranged. So why would they set you up with an account without working out the payments? Sounds shadey! No money paid and no services rendered then it all comes down to if you signed anything. Check it thoroughly! If it doesn't say there is a five day cancellation agreement (which is the most I have ever heard of) then they can go **** themselves. If worst comes to worst pay the $100 or so to sit down with legal council and get them to look the contract over. But do not give them a check until then. If you have to use the check is in the mail speech.

Let the deposit go. You can not get it back! Even if they took you to legislation the worst (in my humble non lawyer opinion) would be you would have to pay for the missed session only. But it all comes down to the contract.

This gym isn't owned by guys named Gweido and Toni is it? If so pay the $1000.

so they can't do anything if i dont hand them my check? i paid in debit is there away they could charge me?

hopefully Canada has an equivelant to the better business beauro(sp too tired to look it up lol) and follow through on reporting them, tell the bank no charges are allowed from the corp, tell the corp your reporting them for illegal, aggresive sales tactics, and that you will sue them. they will go away

Was there a contract? If you have a signed legal document that clearly states that you agree to these rules, your in trouble. You should contact the better buisness bureau. Rev that is a great idea!

yea there was a contract, i signed it. I thought i could get away with it and cancel it any time. man i really wanna kick myself.

lol, still laws esist to protect against aggressive sales tactics. Contact your bank and tell them to company misrepresented itself to you and did not give you the 30 days REQUIRED by US laws at least to deny service. I'm sure Canada has similar consumer protection laws. Give a call to the bank and let them know you deny ALL charges from the corporation and you can probably even get you deposit back.

Read it thoroughly!!!! Does it mention the five day cancellation notice? Does it say you agree to pay in full if you cancel? If you are not sure get advice. You said you go to college? Do any professers have a back ground in law? Get legal advice if you are in anyway unsure of the contract.

They can not take out money if you paid by interac. They need that void check for pre authorized withdrawls. This might be a scare tactic.

The way I see it you can either pay (which is probably not an option) or not pay and see if you get a legal notice. If you can get legal advice do it. If you have to pay and can not afford it wait until they send a legal notice and then seek council.

Check into the better buisness bureau though and see what they can do.

lol Tim & Julie, I always heard repitition was a form of flattery. Hope both of you and all animals are doing fantastic. Sometimes we both are too fast and repeat each others messages lol. Great minds think alike.

what is it with these Fitness Clubs trying to screw ppl. I have heard of this before here in the states too. Just tell them you misunderstood the terms and you only wanted to have the free session for signing up. Then tell them that you just got notice of a job transfer and you will be moving to far away to be able to continue your membership...lol..that worked for my "better half"!!!
