FWS Files Final Rule/ Constrictor Ban
US Fish & Wildlife Service (FWS) has filed a final rule with the White House Office of Management & Budget (OMB). This filing has no material changes from the proposed rule that would add 9 constricting snakes to the Injurious Wildlife list of the Lacey Act. This would make import or interstate transport of the 9 constrictors a felony with heavy fines and potential jail time. This is the final stage of the rule making process. OMB's role is to review the proposed rule to ensure that the costs to businesses do not outweigh the purported benefits. In spite of USARK's information to the contrary, and the Small Business Administration's findings that FWS did not do its due diligence in determining economic impact, we remain unsure of OMB's position. As many as a million American citizens could be negatively impacted if this rule is enacted. It would create a whole new class of criminal out of law abiding citizens engaged in what is now a perfectly legal trade.

There is also likely to be an oversight hearing at the US House Natural Resources Committee because of the potential to destroy a viable $1.4 billion cottage industry; and the flagrant disregard by FWS for mandated process and procedure under the Administrative Procedures Act and Information Quality Act. USARK has uncovered evidence that appears to point to an intentional effort to manufacture science to support a policy directive based on staff preference at FWS. This preference by FWS could mean the loss of thousands of jobs and the destruction of viable sector of our nations economy in a time of hardship.

Members of the Reptile Nation should prepare themselves for the “Big Fight”. This process should take about 45 days to unfold. USARK calls upon the OMB, the US House of Representatives and the US Senate to look closely at how FWS has circumvented due process to create policy based on staff preference. USARK believes that these actions by a government agency, upon close examination, will be found to be arbitrary, capricious and unlawful.

really no one is going to help fight? yes these might not be the kind of snakes you keep but one day they will go after yours please help, wright letters, donate to USARK just do your part to keep this Reptile Nation alive.

Im sure they can, here lol just mail all letters from you and friends to me. Dont state in the letter that your in a different country and I will meail them in for you!! We could use all the help we can get not many people are actually acting on this!!

One on site they had a demo letter you could check out to give you a general idea of what to put in it and where to send it. I just wish i could remember what site.

Ive seen several demo letters, if you all need one I can post it. But I think these demo letters are for different reptile bills

Does anyone have a mailing address for the letters, or would an email to the address in the OP's post suffice?

Also, I haven't been following the ban, what species are they proposing to add to the ban list?

Ok, so what I gathered were:

Indian Python
Burmese Python
Reticulated Python
Northern African Python
Southern African Python
Boa Constrictor
Yellow Anaconda
DeSchauensee’s Anaconda
Green Anaconda
Beni Anaconda

My questions, are the "Northern/Southern African Python's", what we would consider African Rock Pythons?
Also, what is "Boa Constrictor"? Please tell me that isn't relating to all boas...

I will write a letter this weekend, please let me (and everyone) know ASAP where we can send them!


On a side note (that I will probably get flamed for), I don't see it as a completely bad thing that Retic's/Anacondas/Rocks may get banned. Not that I don't think there are some few competent owners out there, I just think 98+% Retic's/Anacondas/Rocks owners will not be able to properly care for their animal for the entirety of their life, and will most likely either release it into the wild where it will cause an immense amount of damage, or kill it.
Again, I'm sure I will get flamed for this, but it's just a personal opinion. Maybe a full out ban is not appropriate, but at least more strict regulations concerning ones ability to own one...

I might add to Jenn's post that you as an individual are not limited to just composing and sending one letter. You can send as many letters as you can afford to stamp. They will most likely not be read but just like the ending of A Miracle on 34th Street, presenting an abundance of letters makes a great visual impact (and movie magic).
