View Full Version : CONCERN price hike after a deal is set in motion....question.

I have a question that is bugging me because I feel I know the answer and feel ethically it is the right answer so I thought maybe ask here and find out if more people feel the same or not.
Here is the scenario.
If a seller puts a snake up for sale and does an advertisement and gets a customer interested to buy it. Then the customer contacts the seller via email and phone and you agree to sell it both in verbal and email response. Then confirms this again once more and the customer puts a deposit on the snake (50%) and during the wait of the deal to complete the customer pays another (25%). Even though the original deal was 50% now and 50% on shipped. Then the seller then changes the deal and hikes up the price. So my question is...
Does the seller have the right to increase the price on the snake over time while waiting to ship and use an excuse that the snake is worth more now?
I myself believe NO, a bought animal even with a deposit is technically bought at that stated price and agreed in the beginning. Unless the buyer chooses to walk from the deal, that animal if sold for (whatever) is still (whatever on day of shipping). Am I wrong for thinking this, or does anyone else think people can hike the price in middle of the deal after payments are made.
I would like to hear your feedback on this. :)

I would say no, as long as the seller doesnt have to keep the snakes months after months and he keeps feeding the snake pricey items ( ex: an afroc on a piglet diet )... That would pretty much be the exeption, but i think you're right.
the price agreed upon should be the price paid. thye have no right to lure you in then jack up the price. thats just makes the seller look bad

Depends on the time interval. If you buy a female Ball out of the egg for $150, but pay $10 a month for a year and 3 months, by which time the snake is 1200g, I sure as heck don't think you're going to get it for $150.
In other words, it all depends. Some snakes REALLY do appreciate in value as they get larger. Others stay the same or get cheaper. Depends.....If I was the breeder, and if a certain time went by, I'd say screw it, and give the money back and keep the animals or sell them to someone else. When you go to the GAP, you don't take 10 months to pay off a T-Shirt.

I saw that Tony. I agree. CITES involved changes everything. I don't think the price can be raised when waiting for CITES paperwork as a 3rd party was involved and you can't be at fault for that.

Its a CITIES thing and I paid 75% of the boa off even though I have enough proof stating the deal was 50% now, 50% after the boa arrives. I know that is not a normal deal but the seller agreed to it and while I waited on CITIES from him, which now I believe he never prepared, I still paid another 25% and a bit more. I paid thousands and was only owing a few hundred left. Only reason I did not front it all was since I have to wait on CITIES, why should I get hit with the highest currency rates during the months of 2004. I was going to pay the boa off no matter what but no reason it should be done early as I still had to wait for the boa. The promise was 30 days maybe 90 days typical CITIES wait frame. But 1 year plus, was insane and this seller was only full of excuses on why paperwork was ready / was not ready. I will have a thread ready on the BOI with more than enough proof showing his mistakes.
Even with that I still wanted to complete the deal just because I paid enough to complete it, I been patient for a year for this boa, if I give up that will be 1 year I lost on a boa project, and lost a chance to buy from other breeders. All in all I feel I was ripped off not just in money. I even offered to get my own CITIES set up with help from a friend, I asked the breeder since you promise to refund me my money and in a month or so I can find CITIES and do it, can I buy this boa still.........his answer sure but she will be $7000 now.........from a deal of $4000 and jacking me $3000..........see why I am screwed.
Not only this but 3 times before through phone and email he tried to back out of the deal, reasons like can' t wait no longer on CITIES. I found out I can sell her in a week for more, she is beautiful and worth much more now. All this and then a promise that May 16, 2005 I was getting my full refund tells me bingo.......this boa was never going be shipped.
I already called the authorities and they wait as I wait on a promise that my refund was set in motion this Friday, but an excuse that at 3pm the wire transfer will not go through until they process it on Tuesday.....I figure you got a customer waiting over a year on his boa, take that away from him, promise a refund on 1 date then lead them on 2 weeks straight with excuse after excuse about refunding him, them going to the bank at 3pm exactly to gain another 4 - 5 days before actually sending that deposit shows this breeder / seller as a crook. I would have been at the bank the moment it opened just to please the customer. And I don' t believe the excuse on his wire transfer rules. It seems Kansas has the only rules like this. I do wire transfers world wide and receive them, I could not even get the so - called teller to verify me a receipt number, code or anything saying that money is locked and mine. What she promised was freezing his account until Tuesday but I wonder even on that, talking to her on the phone I could have been talking to his wife for all I know....reason I say that is because every teller has a name and an ID # they write it on everything they do with each customer to track who did what at any bank.....she could not tell me her number, its public information I checked and legal, but she could not have one.....again the excuses from this deal from Kansas just pissed me off.
Again there will be a BOI thread done on all this to expose this person.

EDIT - I have to accept his excuse for this tranfers but after that its a different game indeed.
That sux Tony, sooo much time lost and no compensation for that either... Best of luck

Thanks guys , either way no deal will silence me, from exposing this thief very soon.
the seller sounds like a rat basterd. if i where you i would try and make sure that seller never made another penny from reptiles. just warn ppl of there shady dealings and i highly doubt anyone will want anything to do with them. then after you get your money back and you spread the truth about the scam artist you can laugh at them. at least you should get to laugh in ther face for all your trouble right?????? i think soo

That kind of thing sucks...I have had it happen to me...seller sets a deal and a price for you, then a new buyer wants the same item and offers more for it. Next thing you know your deal and the animal you were about to buy are both gone! This is what probably happended to you right from the start, then the excuses came because he spent your money all ready!
Just my opinion! By the way what is the BOI forum? Sounds like some good reading!

Up North....the BOI is a separate forum where people say the goods and bads on breeders / seller / importers and so its business. Canadian Board of Inquiry is the name but in short BOI.
If you have a good / bad deal its expressed there kinda like a court if both parties are willing to express there sides.
