It is a garter snake of some sort. Where are you located?

if you have a garden be glad he's there. they eat slugs, small rodents, crickets,etc., that infest gardens. i used to find them and carry them home to my garden.
Scared/pissed off garter, probably a female. Not good enough with garters to give the exact species though. Like it was said, she's good to have around, harmless to people and most pets people keep but very good at getting rid of common garden pests.
Definitely garter. Locality would help so that we could give you a more specific ID.

It took me a second to register it because of the flattened head and body, but yes that's a garter. It's performing a threat display and trying to make itself look big and scary. I'm not slick enough to tell you what subspecies though.

At first glance i thought this might be a water snake. However if op is on the west coast and So. Calif. this may be T.hammondi. A stripeless version of the two striped garter snake. Which area has a intergrade zone with two other species of thamnophis. Just my guess.
